Basic information on common motorcycle accident injuries, the components of a motorcycle accident settlement, and the process of filing a motorcycle accident lawsuit is as follows:
Types of Injuries
Since motorcycles do not offer protection for riders in the event of a crash, motorcycle accident injuries tend to be catastrophic (e.g., spinal cord, back, burn, and brain injury) or fatal. Relatively minor injuries are also common (e.g., broken bones and “road rash”). Victims should secure legal counsel whatever the severity of their injuries, as they may be entitled to damages.
Motorcycle Accident Compensation
A motorcycle accident settlement includes recompense for the financial losses a victim suffers because of a motorcycle accident injury, including his or her medical expenses, lost income, decreased earning potential, and household expenses during recovery. (In cases of wrongful death, the victim’s surviving family members may be able to obtain damages.) The settlement amount depends on a number of factors, including the severity of the victim’s injuries, state law, and the skill of the victim’s lawyer.
Filing a Motorcycle Accident Lawsuit
Filing a motorcycle accident lawsuit is a complex process involving investigating the scene of the accident, determining what party or parties are liable for the accident, and proving those parties’ liability. Filing suit is best undertaken by a practiced motorcycle accident attorney, since a lawyer with a background handling motorcycle accident claims has the expertise necessary to navigate the law and obtain a favorable case outcome for his clients.
