Motorcycle Accident Law
Motorcycle accident law established the rights of individuals injured in motorcycle accidents, whether they involve a motor vehicle, another motorcycle, or a stationary object. When an accident results from another party’s negligence, the injured may sue the responsible party or parties for damages. The amount of compensation a victim obtains depends on a number of factors, including the severity of his or her injuries, the circumstances surrounding the crash, and state motorcycle accident laws.
Types of Injuries
The severity of a motorcycle accident injury depends on a number of factors, including the motorcycle’s rate of speed at the time of the collision, the road and weather conditions, the object with which he or she collided, and whether he or she was wearing a helmet. Although the injuries a motorcyclist sustains can be relatively minor (e.g., road rash and broken bones), motorcycle accident injuries tend to be catastrophic (e.g., back, spinal cord, burn, and brain injury, and even wrongful death).
Filing a Motorcycle Accident Lawsuit
In a motorcycle accident lawsuit, the injured must be able to prove that another party or parties were at least partially responsible for the accident. For example, according to product defect law, the motorcycle’s designers, manufacturers, and distributors can be held liable for a crash caused by a flawed motorcycle part. Motorists or other motorcyclists involved in the crash, those responsible for maintaining the state’s roads, and the injured motorcyclist himself or herself can also be held liable. A motorcyclist who is able to satisfactorily prove the other party’s fault will receive a motorcycle accident settlement or jury award.
